Terms of Service

1. Acceptance of Terms
By creating an account or using the Seeflect platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service.
These terms constitute a legally binding agreement between you (the restaurant or business operator) and Charnam, the company operating Seeflect, based in the Netherlands.
2. The Service
Seeflect provides an AR (augmented reality) menu visualization platform for restaurants and other businesses. The platform enables businesses to create 3D models of their products, generate QR codes for table-side access, and offer guests an interactive AR experience via their phone browser.
Access to Seeflect is subscription-based. Features available to you depend on your subscription plan. We reserve the right to modify, update, or discontinue features with reasonable advance notice.
3. Account Responsibilities
You are solely responsible for:
- —Maintaining the security and confidentiality of your account credentials
- —All activity that occurs under your account
- —Providing accurate and complete billing and contact information
- —Ensuring that all content you upload (photos, dish names, descriptions) is accurate and that you have the rights to use it
You may not share your account credentials with third parties or allow multiple businesses to use a single account.
4. Payments & Billing
Subscriptions are billed monthly on the anniversary of your signup date. Prices are listed in euros excluding VAT, where applicable.
Setup fees are charged once at the start of your subscription and are non-refundable.
Payment processing is handled by Mollie (Netherlands). By providing payment details, you authorise Mollie to charge your payment method on the recurring billing date.
Cancellations take effect at the end of the current billing period. You retain full access to the platform until that date.
Failed payments will be retried for up to 7 days. If payment cannot be collected, your account will be suspended until the outstanding amount is settled.
5. Founder Pricing
Founder Pricing is offered exclusively to the first 25 customers. Once your Founder rate is confirmed, it is locked in for life — meaning it will not increase as long as your subscription remains active and in good standing.
Founder Pricing applies to the monthly subscription fee only. It does not apply to any additional services, add-ons, or setup fees introduced after your subscription start date.
Founder Pricing is non-transferable. If you cancel your subscription, the Founder rate cannot be reinstated — you would rejoin at the standard rate.
6. Acceptable Use
You may not use Seeflect to:
- —Upload content that is illegal, harmful, defamatory, or infringes on third-party intellectual property rights
- —Impersonate another business, brand, or individual
- —Attempt to reverse engineer, decompile, or extract source code from the platform
- —Use automated tools, bots, or scripts to access or scrape the platform
- —Resell or sublicense access to Seeflect to third parties without written permission
Violation of these terms may result in immediate suspension or termination of your account.
7. Uptime & Support
We aim for 99.9% platform uptime. Planned maintenance will be communicated at least 24 hours in advance via email. Unplanned outages will be communicated as quickly as possible.
Support is provided by email at hello@charnam.com. Response times depend on your plan tier: standard customers receive responses within 2 business days; Enterprise customers receive priority support within 1 business day.
8. Termination
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate your account with 30 days' notice if you are in breach of these terms. In cases of serious violation (illegal content, fraud, or security incidents), we may terminate accounts immediately without notice.
Upon termination, your access to the platform ends and your data will be deleted within 30 days.
9. Limitation of Liability
Seeflect is provided on an "as is" basis. We do not guarantee that the service will be uninterrupted, error-free, or meet your specific business requirements.
To the maximum extent permitted by Dutch law, Seeflect (operated by Charnam) shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost revenue, lost profits, or loss of data.
Our total liability to you for any claim arising out of or related to these terms shall not exceed the total fees you have paid to Seeflect in the three months preceding the claim.
10. Governing Law
These Terms of Service are governed by the laws of the Netherlands. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
